Malugod na tinanggap ni Sen. Rodante Marcoleta ang alok ng Philippine Bar Association na isagawa ang debate niya at ni retiradong Supreme Court Senior Associate Justice Antonio Carpio tungkol sa isyu ng pag-aagawan ng teritoryo sa West Philippine Sea.

Dati nang tinanggap ni Carpio ang debate kung saan nag-alok ang samahan ng mga Filipinong abogado na mag-referee dito.

“Doon sa kanilang pangako na magiging kapaki-pakinabang at makabuluhan sa ating mga mamamayan, hindi ko naman tatanggihan yun,” diin ni Marcoleta nang tanungin sa isang programa sa telebisyon gabi ng Lunes.

Matatandaang si Marcoleta ang naghamon kay Carpio, Commodore Jay Tarriela na tagapagsalita ng Philippine Coast Guard at Atty. Jay Batongbakal na isang experto sa batas sa karagatan, sa isang “friendly debate”.

Ito ay matapos imbitahan naman ni Tarriela ang senador sa isang Maritime Domain Awareness tour sa may Kalayaan Island Group.

Bilang mga abogado kapwa kasapi sina Marcoleta, Carpio at Batongbacal ng PBA.

Sinabi ni Carpio na inaasahan niyang na sasakupin ng debate ang legalidad ng pagkakaroon ng West Philippine Sea at ang maritime features ng Kalayaan Island Group na sakop ng WPS.

Nabanggit ni CArpio ang dapat sakupin ng debate matapos na ideklara ni Marcoleta sa Senado naang WPS ay hindi nirerekognisa ng ibang bansa at ang KIG ay nasa labas na ang Exclusive Economic Zone ng Pilipinas.

“Paano naman magtatalo doon, eh sinabi ko yun sa maraming pagkakataon sa aming pagtatalo at pagpapaliwanagan. Sinabi ko yun , the West Philippine Sea does not exist pero dugtungan mo yun - in the contemplation of public international law,” paliwanag ng senador.

Ang mga sumusunod ang imungkahi ni Markoleta na maging paksa ng debate:

“1. Resolve that as the international recognition of WPS is an enforcement of the arbitral award against China in the international forum, NAMRIA and DFA have the duty to define the portion of its limits pertaining to the Philippine Exclusive Economic Zone, deposit the same with the Secretary General and publish the same for other states to be notified.

2.Resolve that as certain KIG features and their territorial seas are outside the Philippine EEZ, and erroneously excluded from the maps marked WPS which were submitted in the South China Sea Arbitration, the DFA and DENR and also Namria have the duty to correct said maps, produce the coordinates and raw joining lines to incorporate the features int he WPS and publish the same for the international community to be notified,

3. Resolve thatthe chart submission and notification are State’s obligation under the UNCLOS.
