LOS ANGELES, California - An 84-year-old woman was awarded $59.25 million in damages after a California civil jury found comedian Bill Cosby of sexually assaulting her in 1972.
The trial set in Santa Monica was concluded in two weeks with the jurors finding the popular comedy actor liable for sexual battery and assault of Donna Motsinger, who was just 30 when the crimes were committed against her.
The jurors awarded Motsinger $17.5 million in past damages and $1.75 million for future damages, for the offenses that resulted in the victim’s “mental suffering, loss of enjoyment of life, inconvenience, grief, anxiety, humiliation and emotional distress.”
An additional $40 million in punitive damages was awarded the victim during the second phase of the trial held Monday.
Lawyer Jennifer Bonjean, Cosby’s legal counsel, vowed to appeal the verdict even as she express disappointment over the juror’s ruling.
Cosby, now 88, was released five years ago from a Pennsylvania prison after being convicted of similar offenses. The Supreme Court ordered his freedom after overturning the ruling of the courts.
He faced many more sexual allegations but settled some of the lawsuits while paying for the awards granted by courts on other cases.
In a statement, Motsinger said: “This verdict is not about me - it’s about finally being heard and holding Mr. Cosby accountable.”
The octogenarian added: “I have carried the weight of what happened to me for more than 50 years. It never goes away. Today, a jury saw the truth and held him accountable.”
In her 2023 civil complaint she was a restaurant service in Sausalito when Cosby invited her to watch his stand-up comedy show at a narby theater in San Carlos.
During the show, Cosby gave her wine and had her take two pills which she thought were aspirins. She was groggy later but noticed two men carry her to a limousine.
According to the civil complaint, Motsinger woke up in her house “with all her clothes off, except her underwear on - no top, no bra and no pants.”
“She knew she had been drugged and raped by Bill Cosby,” the complaint stated.
Both victim and accused were in their 30’s when the incident allegedly took place.
