Naghain nitong Martes (Peb 18) sa Korte Suprema ang ilang abogado at indibidwal mula sa MIndanao ng petisyon upang ipatigil ang pagsasagawa ng Senado ng impeachment trial laban kay Bise Presidente Sara Duterte.

Naganap ito habang naghahanda na ang Mataas na Tribunal na dinggin sa en banc session nito Martes ang naunang petisyon na humihiling na utusan ng hudikatura ang Senado upang agarang dinggin ang impeachment case.

Ayon sa mga pumirma sa petisyon ang articles of impeachment na inihain ng Mababang Kapulungan at pinirmahan ng 240 kongresista ay depektibo. Inakusahan din sa Mataas na Hukuman ang mga kongresista ng paggamit ng ‘grave abuse of discretion” nang aprubahan ang impeachment complaint.

Sa pangunguna nina abogado Israelito Torreon at Martin Delgra III, hiniling ng mga nagpetisyon sa mga mahistrado na maglabas sila ng temporary restraining order na pipigil sa pagbibista ng impeachment case.

Ipinadedeklara rin sa Korte ang pag-deklarang null and void ang articles of impeachment at permanenteng patigilin ang Senado sa pag-aksyon sa umano’y hindi wastong reklamo upang mapatalsik sa puwesto si Duterte.



“This petition likewise prays for the issuance of a writ of prohibition to enjoin and prohibit the Senate of the Philippines from acting on the Articles of Impeachment and from proceeding with the impeachment rial, considering that the initiation of the impeachment complaint was procedurally defective, constitutionally infirm and jurisdictionally void,” paliwanag nila.

Salungat naman dito ang inihaing petisyon ni abogado Catalino Generillo Jr. na humihiling sa Korte Suprema na mag-isyu ng writ of mandamus na maguutos sa Senado ang agarang paglilitis kay Duterte.

Ipinunto ni Generillo, dating special counsel ng Presidential Commission on Good Government, na hindi dapat pinatatagal ang pagsagawa ng pagdinig sapagkat ito ay utos ng Konstitusyon.

“In the final analysis, the Constitution does not allow the Senate to procrastinate during the period it is in recess, whether it shall cnostitute itself into an impeachment court and try the Vice President,” paliwanag ni Generillo.

Ipinahayag ni Senate President Francis Escudero na masisimulan lamang ang paglilitis sa pagbubukas ng sesyon sa darating na Hunyo. Kasalukuyang nasa recess ang Senado bilang paghahanda sa darating na halalan.

Ayon kay Torreon na-proseso ang impeachment complaint sa kabila nang hindi naisagawang committee evaluation. Depektibo rin umano ang verification process na isinagawa ng Kamara.

“The verification process requires that it should be personally known, the allegations, or personally known and studied by the respective congressmen who signed it and if you noticed the congressmen who went there did not even know as to the subject matter of the discussion in the House caucus” palliwanag ni Torreon.

Ang isinampang impeachment complaint sa Senado ay ang ika-apat na case laban kay Duterte. Ang tatlong nauna nang isinampa ay ipina-archive o itinabi na ng mga kongresista.
